"조희대 대법원장이 사법부를 정쟁의 한가운데로 몰아넣었다"는 주장과 "정쟁으로 몰아넣은 것은 민주당"이란 주장이 충돌했다. 국회 법제사법위원회는 이날 오전 전체회의를 열고 공소청법 일부개정법률안, 형사소송법 일부개정법률안 등 5건의 고유법안을 심사했다. 법률안 심사를 위해 노경필 법원행정처장과 이진수 법무부 장관 직무대행이 출석했다. 윤상현 국민의힘 의원은 노경필 처장에게 "집권여당 대표께서 대법원장을 조희대씨라고 그러고 해방 이후 최악의 대법원장이라고 사퇴를 요구하는데 입장이 어떻게 되는가"라고 묻자 노 처장은 "말씀드리기 적절하지 않은 것 같다"고 답했다. 이어 윤 의원은 "한마디로 권위에 대한, 헌법기관에 대한 부정"이라며 이진수 직무대행의 입장을 물었으나 이 직무대행도 "제가 답변드리는 것도 적절하지 않은 것 같다"고 했다. 김승원 더불어민주당 의원은 사법부의 독립은 중요하다"면서도 "지금 조희대 대법원장이 하시는 것을 보면 정말 사법부를 정쟁의 한가운데로 몰아넣고, 우리가 존경해왔던 예전의 대법원장이나 법관의 모습과는 너무나도 동떨어졌다"고 말했다. 이에 박형수 국민의힘 의원은 "대법원을 정쟁의 한가운데로 몰아넣은 것은 민주당"이라며 "우리가 수십년 동안 이뤄왔던 사법권 독립을 거꾸로 가게 하는 것"이라고 반박했다. 한편 김승원 의원은 이날 회의에서 노경필 처장을 두고 "어제 예결위 회의장에서 (노 처장이) '대통령에 대한 재판에 대해서 헌법상 재직중 불소추 규정과 관련해 해석이 분분한 것으로 안다'(고 말한 것에) 저는 깜짝 놀랐다"며 "대통령에 대한 재판, 소추는 중단되는 것이고 그 재판의 시작이 윤석열 정권의 친윤 검사들에 의한 불법 강압수사 조작기소라는 것이 국정조사에서 상당히 드러났는데 어떻게 이런 말씀을 하실 수 있나"라고 물었다. 이에 노 처장은 "학계에서 논의가 있는 것으로 안다"며 "소추 여부의 재판 진행이 가능한지에 대해서는 헌법 교과서도 의견이 분분한 것 같다. 다만 헌법에서의 최종적 권한은 헌법재판소에 있기 때문에 제가 그 문제에 대해서는 더 말씀드리기 어렵다고 생각한다"고 답했다.。
