一 |     A jury in Adams County, Colorado, has found Randy Roedema guilty of criminally negligent homicide and assault in the third degree in the death of 23-year-old Elijah McClain.Roedema and Jason Rosenblatt were the two officers first tried in connection to McClain's death.Rosenblatt was found not guilty on charges of reckless manslaughter, assault in the second degree and criminally negligent homicide.The two men, along with Officer Nathan Woodyard, who was first on the scene, and two paramedics, pleaded not guilty. The trial of Roedema and Rosenblatt lasted almost a month, with opening arguments starting on Sept. 20.The prosecution argued that the two officers violated department protocol by using excessive force against McClain. Prosecutor Jonathan Bunge argued that the two men failed to de-escalate the situation."When Elijah is on the ground handcuffed, he's saying over and over and over again, 'I can't breathe. Please help me,'" said Bunge during opening arguments, adding that McClain vomited after the chokehold and was drowning in vomit."There was no doubt that there was forcible restraint and heard the testimony from Dr. Beuther who said that ketamine is a sedative, but when someone is in respiratory distress they are at greater risk," said Special Assistant Attorney General Duane Lyons during closing arguments.The defense argued that the officers followed their department policies and training, instead blaming McClain's death on the EMTs who later arrived at the scene and gave McClain a shot of ketamine. The EMTs also claimed they were following department protocol at the time."There's little doubt that this case is a tragedy. But if you take the emotion out of this case, which is what you must do, the [prosecution falls] woefully short," said Don Sisson, Officer Roedema's attorney, during closing arguments. "They cannot prove Randy's actions or inactions were criminal in any way."Following the verdict, Attorney General Phil Weiser released a statement thanking the jury and calling attention to Elijah McClain and the McClain family."Today’s verdict is about accountability; everyone is accountable and equal under the law. And hopefully today’s verdict is another step in the healing process for the Aurora community and the state. I recognize that some people may not agree with the verdict, but we all must respect the jury system, which is a pillar of our democratic republic," he said in a statement. "The people who served on the jury are our neighbors, regular Coloradans who interrupted their lives for weeks to hear the evidence in the case, to deliberate, and to deliver justice. I thank the members of the jury for their service."We are here today because Elijah McClain mattered. He was just 23 years old when he died, and he had his whole life ahead of him. His mother, Sheneen McClain, has had to relive that tragic night repeatedly for the last five years. Yet I, and all of us, are inspired by her courage and devotion to her son. Sheneen has been incredibly resilient and determined to not let anyone forget about Elijah. I want to thank Sheneen for her strength, grace, and understanding. Elijah’s memory lives on as a blessing," his statement read.Interim Chief of Police of Aurora, Colorado, Art Acevedo, also posted a statement on X in reaction to the verdicts.“I know many have been waiting a long time for the involved parties to have their day in court," his statement read. "As a nation, we must be committed to the rule of law. As such, we hold the American judicial process in high regard. We respect the verdict handed down by the jury and thank the members of the jury for their thoughtful deliberation and service. Due to the additional pending trials, the Aurora Police Department is precluded from further comment at this time."McClain died after being stopped by police on his way home from a convenience store in August 2019. A passerby called 911 to report McClain as acting "sketchy" with a ski mask on; however, the caller said there was no weapon and that no one was in danger at the time.In police body camera footage, McClain can be heard saying, "I have a right to where I am going."One of the officers told McClain he had a right to stop him because he was "being suspicious."Woodyard then placed McClain in a carotid hold and all three officers moved McClain by force to the grass and restrained him. McClain can be heard pleading with officers in body cam footage, saying he can't breathe correctly.When EMTs arrived at the scene, McClain was given a shot of 500 milligrams of ketamine for "rapid tranquilization in order to minimize time struggling," according to department policy, and was loaded into an ambulance where he had a heart attack, according to investigators.McClain's cause of death, which was previously listed as "undetermined," was listed in the amended report as "complications of ketamine administration following forcible restraint." The manner of death remained listed as "undetermined" as it was in the initial report.The EMTs at the scene, Jeremy Cooper and Lt. Peter Cichuniec, will be tried together at a later date in connection with McClain's death.Woodyard will be tried separately because he was first on the scene and applied the hold, according to a court order.。    5191명 참여 설문서 76% 찬성…불무중 설치안, 주민 공감대 확인“원거리 통학 해소” 기대 속 기존 재학생은 학습권·교육환경 보호 요구설치 확정 아닌 행정 검토 첫발…교육청·천안시의회 후속 결정 주목10년째 이어진 충남 천안 불당동 중학생들의 원거리 통학 문제가 모듈러 교실 설치라는 현실적 해법을 향해 첫발을 뗐다.   천안교육지원청이 26일 천안시 청소년복지센터에서 개최한 ‘아름드리공원 공동사용 및 천안불무중 모듈러 교실 설치를 위한 지역주민·학부모 공청회’에서 설문조사 결과 모듈러 교실 설치에 찬성 의견이 76%를 넘었다.

설문 시스템상 전체 참여 절차 인원은 5191명으로 집계됐으며, 개인정보 수집·이용에 동의한 5178명을 기준으로 한 최종 찬반 조사에서는 3953명(76.34%)이 찬성, 1225명(23.66%)이 반대했다. 불당동 중학교 부족 문제를 둘러싸고 수년간 이어진 갈등 속에서 다수의 주민과 학부모가 모듈러 교실 설치라는 임시·현실적 대안을 선택한 것으로 풀이된다.   이날 공청회는 찬성표의 크기만큼이나 기존 불무중 재학생들의 교육환경을 어떻게 보호할 것인가를 놓고 치열한 의견이 오갔다.
                   
모듈러교실 찬성 반대 의견.
찬성 측은 불당동 학생들이 인근 봉서중과 백석중, 쌍용중 등으로 배정돼 왕복 90분에 가까운 통학을 감수하고 있다며 더 이상 근본 대책만 기다릴 수 없다고 주장했다. 특히 중학교 진학을 앞둔 초등학교 고학년생들의 원거리 배정을 막기 위해서는 불무중 운동장에 모듈러 교실을 설치해 수용 능력을 우선 확대해야 한다는 의견이 제시됐다.   반대 또는 신중론 측은 모듈러 교실 설치 자체보다 기존 재학생들의 학습권 침해를 우려했다. 불무중이 최근 증축공사로 소음과 공사 불편을 겪은 데 이어 또다시 공사가 진행될 경우 학생들의 피로감이 커질 수 있다는 것이다.

운동장 축소에 따른 체육활동 공간, 급식실·화장실·휴게공간 등 학교 인프라, 교직원 업무 부담과 과대학교 문제도 함께 해결해야 한다는 요구가 이어졌다.   공청회에서는 결국 ‘원거리 통학 학생의 학습권’과 ‘기존 재학생의 교육환경’을 선택하는 문제가 아니라 두 문제를 동시에 해결해야 한다는 데 의견이 모였다.   이에 따라 교육당국과 천안시는 모듈러 교실 설치가 추진될 경우 인접 아름드리공원 일부를 체육활동 공간으로 공동 활용하는 방안과 안전대책, 학교시설 추가 개선 등을 함께 검토할 것으로 보인다. 공사 역시 학생들의 수업권 침해를 최소화하기 위해 방학 기간을 최대한 활용해야 한다는 의견이 제시됐다.   이번 설문 결과로 천안교육지원청과 천안시의회의 후속 논의도 빨라질 가능성이 커졌다. 그동안 불당동 중학교 부족 문제의 단기 해법으로 제시됐던 불무중 모듈러 교실 설치안이 주민 다수의 찬성을 확인한 만큼 자체재정투자심사와 예산심의 등 후속 행정 절차 논의가 본격화될 것으로 예상된다.   그러나 모듈러 교실 설치가 확정된 것은 아니다.   교육지원청은 이날 공청회에서도 설문조사는 주민과 학부모 의견을 확인하기 위한 정책 참고자료일 뿐, 결과만으로 사업 추진 여부가 최종 결정되는 것은 아니라고 거듭 설명했다. 후속 행정 절차와 예산 확보, 관계기관 협의 과정에서 추가 논의가 필요하고, 기존 재학생과 학부모들의 반발과 갈등이 계속될 경우 사업 추진에도 변수가 생길 수 있다.。
